Fishingly Terms and Conditions
Effective date: September 18, 2026
Last updated: October 27, 2026
These Terms and Conditions ("Terms") form a binding legal agreement between you ("you," "your," or "User") and Accrevia Labs LLC ("Fishingly," "we," "us," or "our"), the operator of the Fishingly mobile application and all related features, content, and services (together, the "Service").
Please read these Terms carefully. By creating an account, or by downloading, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Service.
1. Eligibility and Age
You must be at least 13 years old to use the Service. If you are under the age of majority in your place of residence, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms. By using the Service you represent that you meet these requirements and that all registration information you provide is accurate and complete.
2. Your Account
To use most features you must create an account. You agree to:
- provide accurate, current, and complete information and keep it up to date;
- keep your login credentials confidential and not share your account;
- be responsible for all activity that occurs under your account; and
- notify us promptly at support@accrevialabs.com of any unauthorized use or security breach.
We may refuse, suspend, or reclaim any username, and may suspend or terminate accounts as described in these Terms.
3. License to Use the Service
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use the Fishingly app on an Apple-branded device that you own or control, for your own non-commercial use, in accordance with the App Store Usage Rules.
You agree not to, and not to permit anyone else to:
- copy, modify, translate, or create derivative works of the Service;
- reverse engineer, decompile, or disassemble any part of the Service, except to the extent this restriction is prohibited by applicable law;
- rent, lease, lend, sell, sublicense, or otherwise transfer the Service;
- remove or alter any proprietary notices;
- access the Service to build a competing product, or scrape, harvest, or collect data from the Service using automated means without our prior written consent; or
- interfere with, disrupt, or attempt to gain unauthorized access to the Service or its related systems.
4. Fishingly Pro Subscriptions and Payments
Certain features are offered through a paid subscription ("Fishingly Pro"). The following applies to subscriptions purchased through the Apple App Store:
- Billing. Payment is charged to your Apple ID account at confirmation of purchase.
- Auto-renewal. Subscriptions automatically renew for the same period at the then-current price unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period.
- Managing and canceling. You can manage or cancel your subscription, and turn off auto-renewal, in your Apple ID account settings at any time. Canceling stops future renewals; it does not retroactively refund the current period.
- Free trials and introductory offers. If a free trial or introductory offer is provided, any unused portion is forfeited when you purchase a subscription, where applicable.
- Price changes. We may change subscription prices. Changes apply to future billing periods and, where required by Apple or by law, will be communicated to you in advance and may require your consent to continue.
- Refunds. Purchases made through the App Store are handled by Apple and are subject to Apple's terms and refund policies. Except where refunds are required by applicable law, payments are non-refundable.
- Statutory rights. Nothing in this section limits any non-waivable consumer rights you may have under the laws of your country or region (for example, statutory rights of withdrawal or cancellation in the EU and UK).
5. Your Content
"User Content" means anything you submit, post, or share through the Service, including catches, posts, articles, photos, captions, comments, messages, saved locations, and profile information.
- Ownership. You retain all ownership rights in your User Content.
- License to us. You grant Fishingly a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, adapt, publish, translate, distribute, and display your User Content solely to operate, provide, promote, and improve the Service. This license ends when your User Content or your account is deleted, except (i) to the extent it has been shared with others who have not deleted it, and (ii) for backups and records kept for a reasonable period.
- Your responsibility. You are solely responsible for your User Content. You represent and warrant that you own or have the necessary rights to it and that it does not violate these Terms or any law or third-party right (including privacy, publicity, and intellectual-property rights).
- Feedback. If you send us suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction or obligation to you.
6. Acceptable Use
Fishingly has zero tolerance for objectionable content and abusive behavior. You agree not to submit User Content or engage in conduct that:
- is unlawful, fraudulent, defamatory, obscene, pornographic, or sexually explicit;
- is harassing, threatening, hateful, or that bullies, intimidates, or targets any person or group;
- depicts, promotes, or facilitates violence, self-harm, or animal cruelty, or that violates fishing, wildlife, or conservation laws (including poaching or the taking of protected or out-of-season species);
- infringes any intellectual-property or other right, or discloses another person's private information without consent;
- contains malware, or spam, or that impersonates any person or misrepresents your affiliation;
- interferes with, or attempts to circumvent, the security or intended operation of the Service; or
- is otherwise objectionable or that we reasonably determine to be harmful to other users or to Fishingly.
7. Reporting, Moderation, and Enforcement
We want Fishingly to be safe and welcoming. Within the app you can report content or users you believe violate these Terms, and you can block other users so you no longer see their content or receive their messages.
We review reports of objectionable content and abusive behavior and act on them, which may include removing content and ejecting the offending user, ordinarily within 24 hours. We may, but are not obligated to, monitor, review, or moderate User Content, and we may remove or restrict any content, or suspend or terminate any account, at our discretion, with or without notice, for any violation of these Terms or as we reasonably consider necessary. To report a concern you may also contact us at support@accrevialabs.com.
8. Fishing Regulations, Safety, and Assumption of Risk
Fishingly is a tool for logging, sharing, and discovering fishing activity. It is not a source of legal, regulatory, navigational, weather, or safety advice.
- Regulations and licenses. You are solely responsible for knowing and complying with all applicable fishing laws, licensing requirements, seasons, size and bag limits, protected-species rules, access permissions, and conservation regulations wherever you fish.
- Data is informational. Tide predictions, solunar and bite forecasts, fish-stocking information, maps, water and weather data, and similar content are provided for general information only, are sourced from third parties and public agencies, may be inaccurate or out of date, and must not be relied upon for safety or navigation. "Scheduled" stocking never means "confirmed." Always verify against official sources.
- Assumption of risk. Fishing, boating, wading, and related activities are inherently dangerous and can result in serious injury or death. You participate at your own risk and are responsible for your own safety and that of those with you. To the fullest extent permitted by law, you assume all risks arising from your use of the Service and your activities in the field.
- Conservation. We encourage ethical angling, respect for other anglers and landowners, and responsible catch-and-release practices.
9. Location and Secret Spots
Some features use your device location to show nearby content and to let you save and share fishing spots. You control the precision of what you share: a catch's location can be shared exactly, shown only as the general water, or kept secret. When you mark a spot or catch as secret, we take reasonable steps to hide the precise coordinates from other users, but you are responsible for what you choose to share, and you should not share locations that would endanger sensitive habitats, private property, or the safety of others. Location features depend on permissions you grant on your device.
10. Intellectual Property
The Service, including its software, design, text, graphics, logos, and the "Fishingly" name and marks, is owned by Fishingly or its licensors and is protected by intellectual-property laws. Except for the limited license granted to you, these Terms do not transfer any right, title, or interest in the Service to you.
11. Third-Party Services and Content
The Service integrates or links to third-party services and data, including mapping, tide and stocking data providers, sign-in providers, and payment processing through Apple. Your use of third-party services may be subject to their own terms and privacy policies, and we are not responsible for third-party services or content. Links and integrations do not imply our endorsement.
12. Privacy
Our Privacy Policy explains how we collect, use, and share information. By using the Service you agree to the practices described there.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, if we are required to by law, or if we discontinue the Service. Upon termination, the licenses you granted for User Content survive to the extent described in Section 5, and provisions that by their nature should survive (including Sections 5, 8, 10, and 14 through 21) will continue to apply.
14. Disclaimer of Warranties
To the fullest extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any content or data will be accurate or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
15. Limitation of Liability
To the fullest extent permitted by law, Fishingly and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or for personal injury or property damage, arising out of or relating to your use of, or inability to use, the Service. To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and nothing in these Terms limits liability that cannot be limited under applicable law.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Fishingly and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms or of any law or third-party right.
17. Changes to the Service and to These Terms
We may modify or discontinue the Service, in whole or in part, at any time. We may also update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by in-app notice or by updating the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
18. Governing Law and Dispute Resolution
Governing law. Except where prohibited by applicable law, these Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, and, where it applies, by the Federal Arbitration Act.
Informal resolution first. Before starting any formal proceeding, you agree to contact us at support@accrevialabs.com and give us 30 days to try to resolve the dispute informally.
Binding Arbitration
If the dispute is not resolved informally, you and Fishingly agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration administered by the American Arbitration Association (AAA) under its then-current rules, rather than in court, except as stated below. The arbitration will take place in San Francisco, California or by videoconference, and judgment on the award may be entered by any court with jurisdiction.
Class Action Waiver
To the fullest extent permitted by law, you and Fishingly agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class or representative proceeding.
Exceptions
Either party may (i) bring an individual claim in small-claims court, and (ii) seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual-property rights or to stop unauthorized access to the Service.
Your Right to Opt Out of Arbitration
You may opt out of the arbitration and class-action-waiver provisions in this Section 18 by sending written notice within 30 days of first accepting these Terms to support@accrevialabs.com, with the subject line "Arbitration Opt-Out," including your name and the email address associated with your account. Opting out does not affect any other part of these Terms. If you opt out, Fishingly will likewise not be bound by these arbitration provisions with respect to you.
Consumers Outside the United States
If you are a consumer residing in the European Union, the United Kingdom, or another jurisdiction whose mandatory laws provide otherwise, the arbitration and class-action-waiver provisions above may not apply to you. Nothing in these Terms deprives you of the protection of the mandatory consumer-protection provisions, or of the right to bring proceedings before the courts, of the country or region in which you reside. EU and UK consumers may also refer disputes to the European Commission's Online Dispute Resolution platform.
19. Apple App Store — Additional Terms
These Terms are between you and Fishingly only, not with Apple Inc. ("Apple"), and Apple is not responsible for the Service or its content. The following apply to your use of the app obtained from the Apple App Store:
- Scope of license. The license granted to you is limited to a non-transferable license to use the app on any Apple-branded products that you own or control, as permitted by the App Store Usage Rules, except that the app may be accessed by other accounts associated with you via Family Sharing or volume purchasing where enabled.
- Maintenance and support. Fishingly is solely responsible for providing any maintenance and support for the app. Apple has no obligation to furnish any maintenance and support services.
- Warranty. Fishingly is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Product claims. Fishingly, not Apple, is responsible for addressing any claims relating to the app, including product-liability claims, claims that the app fails to conform to any legal or regulatory requirement, claims arising under consumer-protection or similar legislation, and intellectual-property claims.
- Intellectual-property claims. In the event of any third-party claim that the app or your use of it infringes that third party's intellectual-property rights, Fishingly, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
20. General
These Terms, together with the Privacy Policy, are the entire agreement between you and Fishingly regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for any delay or failure to perform due to causes beyond our reasonable control.
